By accessing or using 4am ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. We reserve the right to update these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

4am is a WhatsApp-based reminder and automation service that allows users to:

  • Create reminders using natural language through WhatsApp
  • Schedule recurring and one-time notifications
  • Manage reminders through conversational AI interactions
  • Receive automated WhatsApp messages at scheduled times

3. Eligibility

To use our Service, you must:

  • Be at least 13 years of age
  • Have a valid WhatsApp account
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Service under applicable laws

4. Account and Registration

Your account is created automatically when you first interact with our WhatsApp bot. You are responsible for:

  • Maintaining the security of your WhatsApp account
  • All activities that occur under your phone number
  • Notifying us immediately of any unauthorized use
  • Providing accurate information when requested

5. Subscription and Payments

Free Trial: New users receive a 7-day free trial with limited reminders.

Paid Plans: After the trial, continued use requires a paid subscription. Plans include Starter ($4.99/month), Pro ($9.99/month), and Business ($29.99/month).

Billing: Subscriptions are billed monthly or annually through Stripe. Payments are non-refundable except as required by law.

Cancellation: You may cancel your subscription at any time. Access continues until the end of your billing period.

Price Changes: We may change prices with 30 days notice. Continued use after the change constitutes acceptance.

6. Acceptable Use

You agree NOT to use the Service to:

  • Send spam, unsolicited messages, or harass others
  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Transmit malicious code or interfere with the Service
  • Impersonate others or provide false information
  • Use automated systems to abuse the Service
  • Attempt to gain unauthorized access to our systems
  • Use the Service for illegal activities

7. WhatsApp Platform Compliance

Our Service operates through the WhatsApp Business API, subject to Meta's policies:

  • Messages can only be sent within 24 hours of your last interaction
  • We may send keep-alive messages to maintain your service window
  • You must comply with WhatsApp's Terms of Service
  • Service availability depends on WhatsApp platform availability

8. Intellectual Property

All content, features, and functionality of the Service are owned by 4am and protected by intellectual property laws. You retain ownership of the content you create (reminders, messages), but grant us a license to use it to provide the Service.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee:

  • Uninterrupted or error-free operation
  • That reminders will be delivered at exact times
  • Compatibility with all devices or WhatsApp versions
  • That the AI will always understand your requests correctly

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 4am SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, or consequential damages
  • Loss of profits, data, or business opportunities
  • Damages arising from missed or delayed reminders
  • Damages exceeding the amount paid by you in the past 12 months

11. Indemnification

You agree to indemnify and hold harmless 4am, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service or violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time for:

  • Violation of these Terms
  • Non-payment of subscription fees
  • Abusive or fraudulent behavior
  • Extended periods of inactivity

Upon termination, your reminders will be deleted and you will lose access to the Service. You may request a copy of your data before termination.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where 4am operates, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
